¿ES NACIONAL DE VENEZUELA?
PUEDE SER ELEGIBLE PARA EL ESTATUS DE PROTECCIÓN TEMPORAL (TPS)
AVISO: El 3 de agosto, el secretario de Seguridad Nacional, Alejandro N. Mayorkas, anunció las extensiones en los periodos de inscripción inicial de 180 días a 18 meses para solicitantes iniciales (nuevos solicitantes) bajo las designaciones de Venezuela, Siria y Birmania al Estatus de Protección Temporal (TPS).
El periodo de inscripción de 18 meses para las solicitudes iniciales bajo la designación de Venezuela al TPS ahora vence el 9 de septiembre de 2022.
Si usted es ciudadano venezolano en los EE. UU. y no tiene un estatus migratorio permanente aquí, es posible que pueda solicitar el Estatus de Protección Temporal (TPS), que le permitiría vivir y trabajar legalmente en los EE. UU. durante el tiempo que Venezuela esté designado como país TPS.
¿Qué es el estatus de protección temporal?
El Estatus de Protección Temporal (TPS) es un estatus que le permite vivir y trabajar legalmente en los EE. UU. Es válido por 18 meses a la vez, le permite solicitar un permiso de trabajo y un Número de Seguro Social, y puede renovarse siempre que Venezuela sea designado como país TPS.
¿Cuándo puedo solicitar el TPS?
El período de registro de TPS para ciudadanos venezolanos está abierto desde el 9 de marzo de 2021 y termina el 9 de septiembre de 2022.
¿Qué documentos necesitaré para mi solicitud de TPS?
Para solicitar el TPS, deberá demostrar tres cosas:
(1) Prueba de Nacionalidad Venezolana
• Pasaporte, acta de nacimiento con identificación con foto, O documento nacional de identidad de Venezuela con su foto y/o huella digital.
(2) Fecha de entrada
• Sello de entrada de pasaporte, registro de llegada/salida I-94 u otros documentos que comprueben su entrada a los EE. UU. el 8 de marzo de 2021 o antes.
(3) Residencia continua en EE. UU. desde el 8 de marzo de 2021 o antes hasta el presente:
• Registros de empleo (talones de pago, formularios W-2, transcripciones de impuestos del IRS, verificación estatal de la presentación de impuestos estatales, cartas de su empleador, estados de cuenta de los bancos con los que ha hecho negocios).
• Recibos de alquiler, facturas de servicios públicos (gas, electricidad, teléfono, etc.), recibos o cartas de empresas que muestren las fechas en que recibió el servicio.
• Registros escolares (boletas de calificaciones, cartas, etc.) de las escuelas a las que usted o sus hijos asistieron en los EE. UU., que muestren los nombres de las escuelas y las fechas de asistencia.
• Registros hospitalarios o médicos del tratamiento que usted o sus hijos recibieron, que muestren el nombre del centro médico o médico y las fechas del tratamiento u hospitalización.
• Declaraciones de iglesias, sindicatos u otras organizaciones, relativas a su residencia y que lo identifiquen por su nombre.
• Otros documentos diversos, como certificados de nacimiento de sus hijos nacidos aquí, transacciones bancarias y transferencias bancarias fechadas, cartas, tarjeta del Seguro Social de EE. UU., licencia de conducir, tarjeta de Servicio Selectivo, contratos, hipotecas, pólizas de seguro, etc.
Si soy de Venezuela, ¿se me garantiza el TPS?
No. Incluso si es de Venezuela, no sería elegible para TPS si:
1. ha regresado voluntariamente a Venezuela o a un país en el que residió habitualmente por última vez fuera de los EE. UU.;
2. no ha residido continuamente en los EE. UU. desde el 8 de marzo de 2021;
3. ha sido condenado por cualquier delito mayor o 2 o más delitos menores cometidos en los Estados Unidos.
Si alguna vez ha sido arrestado, citado o condenado por un delito, debe obtener un Certificado de disposición para cada asunto y debe hablar con un experto en las leyes de inmigración antes de solicitar el TPS.
¿Qué formularios tendré que presentar?
Para solicitar el TPS, deberá presentar al menos el Formulario I-821.
Si desea un documento de autorización de empleo (permiso de trabajo), también deberá presentar el Formulario I-765.
Si desea solicitar una exención de tarifas, deberá presentar el Formulario I-912 (o solicitar una exención de tarifas por escrito). Es posible que deba presentar el Formulario I-601, si se aplican ciertos “motivos de inadmisibilidad” en su caso.
Todos los formularios se pueden descargar de forma gratuita desde el sitio web de USCIS (www.uscis.gov), pero hay tarifas de presentación que deben pagarse, a menos que no se apliquen las tarifas.

ALERT: On August 3, Secretary of Homeland Security Alejandro N. Mayorkas announced the extensions of the registration periods from 180 days to 18 months for initial (new) applicants under the Temporary Protected Status (TPS) designations for Venezuela, Syria, and Burma.
The 18-month registration period for initial applications under the TPS designation for Venezuela now runs through Sept. 9, 2022.
If you are a Venezuelan national in the U.S. and you do not have permanent immigration status here, you may be able to apply for Temporary Protected Status (TPS), which would allow you to live and work legally in the U.S. for as long as Venezuela is designated a TPS country.
What is Temporary Protected Status?
Temporary Protected Status (TPS) is a status that allows you to live and work legally in the U.S. It is valid for 18 months at a time, allows you to apply for a work permit and a Social Security Number, and may be renewed for as long as Venezuela is designated a TPS country.
When can I apply for TPS?
The TPS registration period for Venezuelan nationals is open from March 9, 2021 and ends on September 9, 2022.
If I am approved, how long will TPS be valid for?
The current period of TPS for Venezuela starts on March 9, 2021 and ends on September 9, 2022. The U.S. government could choose to extend TPS for Venezuela. If it does get extended and you were approved during this current registration period, you would need to renew your registration during the next registration period.
What documents will I need for my TPS application?
In order to apply for TPS, you will need to prove three things:
(1) Proof of Venezuelan Nationality
• Passport, birth certificate with photo identification, OR national identity document from Venezuela with your photo and/or fingerprint.
(2) Date of Entry
• Passport entry stamp, I-94 Arrival/Departure Record, OR other documents that prove your entry to the U.S. on or before March 8, 2021.
(3) Residence in U.S. from on or before March 8, 2021 to the present:
• Employment records (pay stubs, W-2 forms, IRS tax transcripts, state verification of filing state taxes, letters from your employer, statements from banks with whom you have done business).
• Rent receipts, utility bills (gas, electric, phone, etc.), receipts, or letters from companies showing dates you received service.
• School records (report cards, letters, etc.) from schools you or your children attended in the U.S., showing names of the schools and dates of attendance.
• Hospital or medical records for treatment you or your children received, showing name of the medical facility or physician and the dates of treatment or hospitalization.
• Attestations by churches, unions or other organizations, concerning your residence and identifying you by name.
• Other miscellaneous documents, such as birth certificates of your children born here, dated bank transactions and wire transfers, letters, U.S. Social Security card, driver’s license, Selective Service card, contracts, mortgages, insurance policies, etc.
If I am from Venezuela, is TPS guaranteed for me?
No. Even if you are from Venezuela, you would be ineligible for TPS if:
- you have voluntarily returned to Venezuela or to a country in which you last habitually resided outside the U.S.;
- you have not continuously resided in the U.S. since March 8, 2021;
- you have been convicted of any felony or 2 or more misdemeanors committed in the United States. If you have ever been arrested, cited or convicted of an offense, you should obtain a Certificate of Disposition for each matter, and you should speak to an immigration law expert before applying for TPS.
Which forms will I need to file?
To apply for TPS, you will need to file at least Form I-821. If you would like an employment authorization document (work permit), you will need to also file Form I-765. If you would like to request a fee waiver, you will need to file Form I-912 (or ask for a fee waiver in writing). You might need to file Form I-601, if certain “inadmissibility grounds” apply in your case.
What is the cost to apply for TPS?
